Can We Trust Him?
He’s founded some of the most innovative companies of our time, including PayPal, SpaceX, and Tesla. He’s been called the real-life Iron Man and compared to Steve Jobs. But can we trust him?
The Federal Trade Commission (FTC) and Securities Exchange Commission (SEC) is currently investigating whether he made false statements about taking Tesla private on Twitter in August 2018.
The FTC could charge him with deceptive acts or practices under Section 5(a) of the Federal Trade Commission Act, which bars unfair or deceptive acts or practices in or affecting commerce. In this case, they would consider his actions misleading regarding whether he was seeking funding from Saudi Arabia’s sovereign wealth fund for a take-private deal.
The SEC also considers misleading statements on social media as violations of securities law; even if Musk doesn’t admit guilt, his company could face penalties for such violations.
In the not-so-distant past, Apple was facing some pretty dire straits. Its stock had hit rock bottom, and many questioned whether or not the company would survive in the tech world without its enigmatic co-founder, Steve Jobs.
